Who is Eligible for Adjustment of Status?

IF YOU OR YOUR RELATIVE LIVING IN THE UNITED STATES IS THINKING ABOUT GETTING A GREEN CARD, THEN YOU’RE PROBABLY LOOKING INTO THE ADJUSTMENT OF STATUS PROCESS. THIS ARTICLE COVERS MOST OF THE CATEGORIES OF PERSONS GENERALLY ELIGIBLE FOR ADJUSTMENT OF STATUS.

Immediate relatives of U.S. citizens: Spouses, unmarried children under 21 years of age, and parents of U.S. citizens 21 years of age or older

Relatives of U.S. citizens or Lawful Permanent Residents (family-based preference category)

K-1 fiancé(e) of a U.S. citizen

Widow(er) of a deceased U.S. citizen

Self-petitioners under the Violence Against Women Act (VAWA)

Foreign national workers under an employment-based preference category

Foreign national entrepreneurs

Special immigrants: Religious workers, special immigrant juveniles, certain Afghans and Iraqis, certain international broadcasters, certain U.S. armed forcesmembers, & more

Human trafficking or Crime victims

Persons granted Asylum or Refugee status

Persons qualifying under Diversity Visa Lottery program

Persons qualifying under Nicaraguan Adjustment and Central American Relief Act (NACARA)

Persons qualifying under INA 245(i)

Derivative applicants (filing based on a principal applicant), such as K-2

 

If you or your relative fits one of the above categories, remember that you must still show that the applicant is not “barred” from adjusting status, and does not fall under one of the “grounds of inadmissibility.” Due to the complexity of those areas, it is always a good idea to consult with an immigration attorney to further determine your eligibility for a green card.
